Terms & Conditions

These Terms & Conditions (“Terms”) form a binding agreement between you and thinkgood. Please read them carefully. By accessing or using our website, app, newsletter, or related services, you agree to be bound by these Terms.

1. Acceptance of these Terms

thinkgood (“thinkgood,” “we,” “us,” or “our”) provides a consumer brand for cognitive wellness that curates, rates, and creates products and content to help people think more clearly. These Terms govern your access to and use of our website at www.thinkgood.app, our applications, our newsletter, and any related content, features, and services (collectively, the “Services”).

By accessing or using the Services, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms. If you do not agree to these Terms, you must not access or use the Services. We may modify these Terms at any time as described in Section 12, and your continued use of the Services constitutes acceptance of the modified Terms.

2. License and acceptable use

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services for your own personal, non-commercial purposes. We reserve all rights not expressly granted to you.

You agree that you will not, and will not permit others to:

  • use the Services in any unlawful manner, for any unlawful purpose, or in violation of these Terms or any applicable law or regulation;
  • copy, reproduce, distribute, publicly display, modify, create derivative works from, sell, license, or otherwise exploit the Services or their content except as expressly permitted;
  • scrape, crawl, harvest, data-mine, or use automated means to access or extract content from the Services without our prior written consent;
  • reverse-engineer, decompile, disassemble, or attempt to derive the source code or underlying methodology of the Services, except to the extent such restriction is prohibited by law;
  • probe, scan, test the vulnerability of, breach, or circumvent any security or authentication measures, or otherwise interfere with or disrupt the integrity or performance of the Services;
  • upload or transmit any viruses, malware, or other harmful code, or use the Services to harass, abuse, defame, or harm any person or entity;
  • misrepresent your identity or affiliation, or impersonate any person or entity.

We reserve the right, in our sole discretion, to suspend or terminate your access to the Services at any time, with or without notice, for any conduct we believe violates these Terms or is otherwise harmful to us, other users, or third parties.

3. Ratings, content, and no professional advice

thinkgood publishes scores, ratings, reviews, methodology, and editorial commentary regarding digital and physical products. All such material reflects our own independent opinions and analysis and is provided for general informational purposes only. It does not constitute, and must not be relied upon as, professional, medical, psychological, health, financial, legal, or other advice. You should obtain independent professional advice before making any decision based on the Services.

Our ratings are statements of opinion protected as such. We are not affiliated with, endorsed by, sponsored by, or partnered with the companies or products we rate unless expressly stated. No person or company can pay us to appear, to rank higher, to alter a score, or to avoid being rated. All third-party product names, logos, and trademarks are the property of their respective owners and are used solely for identification, commentary, and comparison, which we believe constitutes fair use.

4. Intellectual property

The Services and all content, features, and functionality within them — including our text, ratings, methodology, data compilations, graphics, branding, trademarks, design, look and feel, and software — are owned by thinkgood or our licensors and are protected by copyright, trademark, and other intellectual-property laws of the United States and other jurisdictions. The “thinkgood” name and logo are our trademarks and may not be used without our prior written permission.

You may view, share, and link to our content for personal, non-commercial purposes with appropriate attribution. Any other use — including republication, redistribution, commercial use, or the creation of a derivative or competing product or dataset — is strictly prohibited without our prior written consent.

5. User submissions and feedback

If you submit feedback, suggestions, app requests, appeals, reviews, or any other content or communications to us (“Submissions”), you grant thinkgood a perpetual, irrevocable, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, and otherwise exploit such Submissions for any purpose related to operating and improving the Services, without obligation, attribution, or compensation to you. You represent and warrant that you own or otherwise control all rights to your Submissions and that they do not infringe or violate the rights of any third party.

6. Third-party links and content

The Services may contain links to, or content from, third-party websites, applications, products, or services that we do not own or control. We provide these solely for convenience and do not endorse and are not responsible for the availability, accuracy, content, products, policies, or practices of any third party. Your access to and use of any third party is at your own risk and subject to that third party's own terms and privacy policy.

7. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND ALL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, ACCURATE, COMPLETE, OR CURRENT, OR THAT ANY DEFECTS WILL BE CORRECTED.

8. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THINKGOOD OR ITS OFFICERS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICES, OR YOUR RELIANCE ON ANY CONTENT OR RATING, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

9. Indemnification

You agree to defend, indemnify, and hold harmless thinkgood and its officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Services, your Submissions, or your violation of these Terms or any applicable law or third-party right.

10. Governing law and dispute resolution

These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the State of California, without regard to its conflict-of-laws principles. You agree that any dispute not otherwise resolved shall be subject to the exclusive jurisdiction of the state and federal courts located in California, and you consent to personal jurisdiction and venue there. Any claim must be brought within one (1) year after it arises, or it is permanently barred.

11. Termination

We may suspend or terminate your access to the Services at any time, for any reason, without notice or liability. Upon termination, the licenses granted to you will end, and the provisions of these Terms that by their nature should survive — including Sections 4, 5, 7, 8, 9, and 10 — will continue to apply.

12. Changes to these Terms

We may revise these Terms from time to time in our sole discretion. When we do, we will update the “Last updated” date above and, where appropriate, provide additional notice. Changes are effective when posted. Your continued use of the Services after changes take effect constitutes your acceptance of the revised Terms.

13. Miscellaneous

These Terms constitute the entire agreement between you and thinkgood regarding the Services and supersede any prior agreements. If any provision is held to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign these Terms without our prior written consent; we may assign them freely.
